1) Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of everpaws.shop (the “Site”), including any purchases, content, and services provided by EverPaws (“EverPaws,” “we,” “us,” or “our”). By using the Site, creating an account, or placing an order, you agree to these Terms and our Privacy Policy.

2) Eligibility & Accounts

• You must be at least the age of majority in your jurisdiction to purchase from the Site.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• Provide accurate, current information and promptly update it as needed.
• We may suspend or terminate accounts for suspected fraud, abuse, or violations of these Terms.

3) Orders, Payment & Pricing

• Offer & acceptance: Your order is an offer; we accept when we dispatch the goods or otherwise confirm acceptance.
• Payment: We accept major cards and digital wallets (availability may vary). Payments are processed by third-party providers; we do not store full card numbers.
• Pricing & errors: Prices, promotions, and availability are subject to change without notice. We may cancel or correct orders if a price or description was inaccurate.
• Taxes & duties: Applicable taxes are calculated at checkout. International orders may incur duties or fees collected by the carrier.
• Fraud prevention: We may refuse, cancel, or limit quantities at our discretion to prevent abuse or fraud.

4) Shipping & Delivery

Shipping methods, processing times, and delivery estimates are described in our Shipping Policy. Risk of loss passes to you upon delivery to the carrier, except where prohibited by law. Split shipments may occur.

5) Returns, Refunds & Exchanges

Our Refunds & Returns page explains eligibility, timelines, and instructions. Certain items are not returnable (e.g., used, soiled, personalized, or “Final Sale” items). Refunds are issued to the original payment method after inspection unless otherwise stated.

6) Product Info, Safety & Use

• Colors, dimensions, and materials may vary slightly due to manufacturing or display settings.
• Always supervise pets when introducing new products, especially heavy chewers.
• Discontinue use if a product shows significant wear or damage.
• Our products are not medical devices and are not intended to diagnose, treat, or cure any condition.

7) Reviews, UGC & License

If you submit reviews, photos, videos, or other content (“UGC”), you represent that you own or control the rights to that content and it does not infringe the rights of others. You grant EverPaws a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display your UGC in any media for marketing, promotion, and operations. We may edit or remove UGC at our discretion.

8) Prohibited Conduct

• Violating laws or rights of others; posting unlawful, defamatory, or infringing content.
• Attempting to interfere with the Site, including introducing malware or scraping without permission.
• Reselling or exploiting the Site or content for commercial purposes not expressly permitted.

9) Intellectual Property

The Site, including text, graphics, logos, and other materials, is owned by EverPaws or its licensors and is protected by intellectual property laws. You may not use our trademarks or content without prior written permission except as allowed by law.

10) Third-Party Services

The Site may link to third-party websites, apps, or services. We are not responsible for their content, policies, or practices. Your use of third-party services is subject to their terms.

11) Disclaimers

EXCEPT AS REQUIRED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Some jurisdictions do not allow limitations on implied warranties; these limitations may not apply to you.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERPAWS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR PRODUCTS WILL NOT EXCEED THE AMOUNT YOU PAID TO EVERPAWS FOR THE PRODUCT(S) AT ISSUE IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow limitations; these may not apply to you.

13) Indemnification

You agree to defend, indemnify, and hold harmless EverPaws and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your breach of these Terms or your misuse of the Site or products.

14) Governing Law & Venue

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction and venue of the state or federal courts located in California, USA to resolve any dispute that is not subject to informal resolution or a mutually agreed alternative dispute process.

15) Changes to Terms

We may update these Terms from time to time. When we do, we change the “Last updated” date above. Material changes may be highlighted on this page. Continued use of the Site after changes means you accept the updated Terms.

16) Miscellaneous

• Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
• No waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment: You may not assign your rights under these Terms; we may assign ours as permitted by law.
• Entire agreement: These Terms, along with policies referenced here, constitute the entire agreement between you and EverPaws regarding the Site and products.
